Terms

These terms apply to your use of this website and to the services we provide. Your written proposal and onboarding agreement set out your specific services, fees and conditions. If they differ from these terms, your proposal and onboarding agreement take priority.

1. About us

Welch Marketing Ltd, a company registered in England and Wales, company number 13328901. Registered office: Maidstone House, 9 Maidstone House, King Street, Maidstone, Kent, ME15 6JQ.

We also operate from Dubai through Welch Web Design FZCO, IFZA licence number 86411, IFZA Property FZCO, Building A1, Dubai Digital Park, Dubai Silicon Oasis, Dubai, UAE.

2. Using this website

The content on this website is for general information. Figures in case studies are real results for the clients named and are not a promise of what any other business will achieve. You must not misuse the website, attempt to gain unauthorised access, or copy our content, designs or code without written permission.

3. Our services

The Welch Growth Engine is a done for you system covering website, Meta advertising, funnels, WelchCRM, automations and SEO. It is available with a new website, or without the website build as our Meta ads package, where SEO on your existing website is optional. Everything goes live within five working days of onboarding, provided we have received the access, information and approvals we ask for. The eight week programme starts from go live and is focused on optimisation and scaling, after which you move to a monthly plan.

We also provide websites, SEO, logo design, rebranding, full branding, quote and invoice templates, business cards, leaflets and marketing strategy plans as separate services.

4. Advertising spend

Meta advertising spend is completely separate from our fees. It is paid by you directly to Meta, using your own payment method, and is never included in, collected by or refunded by Welch Marketing. You remain responsible for your advertising accounts and their payment methods.

5. Fees and payment

Fees, payment dates and any deposits are set out in your proposal. All fees are subject to VAT. We may pause work if payments are overdue.

5a. Refunds

For the Growth Engine, the Meta ads package and any other Growth Engine service, you can cancel for a full refund of our fees within 48 hours of starting with us. After 48 hours no refunds are given, and the 60 day guarantee in section 7 applies instead. Meta ad spend is paid directly to Meta and is not refundable by us.

6. Your responsibilities

  • Give us timely access to the accounts, information, photos and approvals we need.
  • Make sure anything you supply is accurate, lawful and yours to use.
  • Respond to the leads we generate promptly.
  • Keep WelchCRM up to date: move leads through their stages and record quote and job values. Your reporting, your projections and the guarantee depend on it.
  • Hold any licences, accreditations and insurance your trade requires.

7. The 60 day guarantee

Our promise: we double your investment in 60 days, or we keep working for free until we have.

  • It applies to Welch Growth Engine and Meta ads package clients.
  • Your investment is the fee you pay us for the eight week Growth Engine programme.
  • The 60 days run from the date your campaigns go live.
  • Progress is measured by the value of the jobs you mark as won in WelchCRM.
  • It depends on two things from you:
    • You call every lead within 5 minutes of it coming in. Leads that come in between 8pm and 8am are called by 9am the next morning.
    • You log every lead and its outcome in WelchCRM.
  • It depends on you meeting the responsibilities in section 6 and keeping to the advertising budget agreed at onboarding.
  • If the target is not reached, we continue delivering our services without charging our fees until it is. Advertising spend and third party costs remain payable.
  • There’s no time limit on the free work, as long as you keep meeting these conditions.
  • The full conditions are in your onboarding agreement, which takes priority over this summary.

7a. SEO terms and the page one guarantee

  • SEO is available on a website we build or on your existing website.
  • SEO runs on a 12 month minimum term. If you pay the 12 months upfront, you receive two months free.
  • Our page one guarantee: your main keywords will reach page one of Google within six months in at least three of your locations, or you get your money back.
  • The main keywords and locations are agreed in writing at the start of your SEO service.

8. Area exclusivity

We work with one business per trade in each area. Your area is the postcode districts your ads target, agreed at onboarding and confirmed in writing. It stays yours while you’re on the Growth Engine programme, including any free work under the guarantee, or on a paid monthly plan that includes ads. Website and hosting only plans don’t hold an area. If your plan ends, your area is released.

9. Results

Apart from the guarantees above, we do not promise specific numbers of leads, rankings or revenue. Advertising platforms and search engines are outside our control and can change without notice.

10. Ongoing plans

After the eight week programme, Growth Engine and Meta ads clients move to a monthly plan with no lock in. SEO has the 12 month minimum term in section 7a. Notice periods for ongoing plans are set out in your proposal.

11. Ownership

Once paid in full, you own your domain and the content created specifically for your website. We keep ownership of WelchCRM, our templates, code, frameworks and know how. You may use WelchCRM while you are an active client or on a hosting plan.

12. WelchCRM accounts

Logins are personal. Keep your password secure and tell us straight away if you think an account has been accessed without permission.

13. Data protection

Where we process your customers’ personal data, we do so as your processor under a data processing agreement. Our privacy policy explains how we handle your own data.

14. Liability

Our total liability to you in any 12 month period is limited to the fees you paid us in the three months before the claim. We are not liable for loss of profit, loss of business or indirect loss, or for decisions made by third party platforms such as account restrictions or algorithm changes. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.

15. Ending our agreement

Either of us may end the agreement as set out in your proposal, or straight away if the other seriously breaches these terms and does not put it right within 14 days of being asked.

16. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
