These Terms and Conditions ("Terms") govern your use of the services provided by Welch Marketing Ltd ("we", "us", "our"), a company registered in England and Wales (Company No: 13328901) with its registered office at Maidstone House, King Street, Maidstone, Kent, ME15 6JQ.
By purchasing or using any of our services, you ("the Client", "you") agree to be bound by these Terms. If you do not agree, please do not use our services.
We provide digital marketing services for tradesmen and trade businesses across the UK, including but not limited to:
Meta Ads lead generation, website design and development, search engine optimisation (SEO), AI-powered CRM systems, and website hosting and management.
The specific scope of services will be agreed upon before commencement and confirmed in writing (via email, proposal, or invoice).
3.1 All prices are quoted in GBP (£) and are exclusive of VAT unless otherwise stated. VAT at the prevailing rate will be added where applicable.
3.2 Payments are processed securely via Stripe. By making a purchase, you agree to Stripe's terms of service.
3.3 For subscription services (SEO, CRM, hosting), payments are taken monthly or annually as selected at the time of purchase. You authorise recurring charges until cancelled.
3.4 Late or failed payments may result in suspension of services. We reserve the right to charge interest on overdue amounts at 8% above the Bank of England base rate.
4.1 Scope: Website design packages include custom design, professional copywriting, mobile-responsive development, contact forms, and basic SEO setup as described on our website.
4.2 Revisions: All packages include unlimited revisions. Revisions must be reasonable and within the scope of the original brief. Significant scope changes may incur additional charges, which will be agreed in advance.
4.3 Content: We will write all content unless you provide your own. You are responsible for the accuracy of any information you provide to us.
4.4 Hosting: Website design packages include free hosting for the first 12 months from the date of launch. After the first year, hosting is charged at the prevailing Basic Hosting rate (currently £39/month + VAT or £390/year + VAT) unless you are subscribed to an SEO plan, which includes hosting.
4.5 Ownership: Upon full payment, you own the website content and design. We retain ownership of any proprietary code, frameworks, or systems used to build the site.
5.1 We guarantee that your website will be live within 48 hours of your onboarding call. If we fail to deliver a live website within this timeframe, you are entitled to a full refund of the website design fee.
5.2 Conditions: This guarantee is subject to the following conditions:
(a) You must attend the scheduled onboarding call and provide all requested information (business name, contact details, photos, and any specific requirements) during or before the call.
(b) The 48-hour period begins at the conclusion of the onboarding call and covers business hours (Monday to Friday, 9am to 6pm GMT).
(c) If you request changes, revisions, or additional features after the initial build is delivered, the 48-hour guarantee is considered fulfilled. The delivery of the initial website within 48 hours satisfies this guarantee, regardless of subsequent revision requests.
(d) Delays caused by third parties (e.g., domain registrars, DNS propagation, hosting providers) are excluded from the 48-hour timeframe.
(e) To claim a refund under this guarantee, you must notify us in writing within 7 days of the missed deadline.
6.1 Scope: Our Meta Ads service includes campaign creation, management, and optimisation on Facebook and Instagram, an AI-powered CRM system, automated lead follow-up, and monthly reporting.
6.2 Ad Spend: Ad spend is paid separately by you directly to Meta. The minimum recommended ad spend is £20 per day. Ad spend is not included in our management fee and is non-refundable by us.
6.3 Pricing: The Meta Ads management fee is £3,000 upfront for the first 3 months, followed by £500 per month thereafter. There is no lock-in contract after the initial 3-month period.
7.1 We guarantee that our Meta Ads service will generate at least £6,000 in profit for your business within the first 90 days. If we fail to achieve this, we will refund the full £3,000 management fee.
7.2 Conditions: This guarantee is subject to the following conditions:
(a) You must actively work the leads we generate. This means responding to leads promptly (within 24 hours), attending scheduled appointments, providing accurate quotes, and making reasonable efforts to convert leads into paying jobs.
(b) The £6,000 profit threshold is calculated based on jobs won from leads generated through our Meta Ads campaigns during the 90-day period. "Profit" means revenue minus direct costs (materials, subcontractors) but does not include your own labour costs or overheads.
(c) If we have generated a substantial volume of qualified leads (defined as 50 or more leads that provided valid contact details and expressed genuine interest in your services) and you have failed to convert them due to your own actions or inactions (e.g., not responding, quoting too high, poor customer service), the guarantee is void.
(d) You must maintain the minimum recommended ad spend of £20/day throughout the 90-day period. Pausing or significantly reducing ad spend voids this guarantee.
(e) You must not make changes to ad campaigns, landing pages, or CRM automations without our approval.
(f) To claim a refund under this guarantee, you must notify us in writing within 14 days of the 90-day period ending, providing evidence that the profit threshold was not met.
8.1 Scope: SEO packages include on-page optimisation, off-page link building, local citation management, Google Business Profile optimisation, and monthly reporting, as described on our website.
8.2 Minimum Term: SEO services require a minimum commitment of 6 months. This reflects the time required for SEO to deliver meaningful results.
8.3 Page 1 Guarantee: We guarantee that your website will rank on page 1 of Google for at least one primary keyword relevant to your trade and location within 6 months. If we fail to achieve this, you are entitled to a full refund of all SEO fees paid during that period. This guarantee applies to organic search results and does not include paid advertisements or the Google Maps/Local Pack (although we will optimise for this too). Highly competitive keywords in saturated markets may take longer; in such cases, we will discuss realistic expectations during onboarding.
9.1 Our CRM service includes automated lead follow-up, missed call text-back, review request automation, pipeline tracking, and email/SMS campaigns.
9.2 CRM is charged at £300 per month with no minimum contract. You may cancel at any time with 30 days' notice.
9.3 We are not liable for SMS/call delivery failures caused by mobile carriers, network issues, or the recipient's device settings.
10.1 Basic Hosting includes website hosting, domain management, SSL certificate, daily backups, security monitoring, and WordPress/plugin updates.
10.2 Hosting is charged at £39/month + VAT or £390/year + VAT.
10.3 Cancellation requires 30 days' written notice. Upon cancellation, you may request a copy of your website files and database, which we will provide within 14 days.
11.1 For subscription services (SEO, CRM, hosting), you may cancel with 30 days' written notice after any minimum term has been fulfilled.
11.2 Website design fees are non-refundable once the onboarding call has taken place and work has begun, except under the 48-hour guarantee (see Section 5).
11.3 Meta Ads management fees are non-refundable except under the 90-day money-back guarantee (see Section 7).
11.4 Annual payments are non-refundable on a pro-rata basis unless required by law.
12.1 Our total liability to you for any claim arising from our services shall not exceed the total fees paid by you in the 12 months preceding the claim.
12.2 We are not liable for any indirect, incidental, or consequential damages, including loss of profits, loss of business, or loss of data.
12.3 We do not guarantee specific results from marketing campaigns. While we use proven strategies and provide guarantees as outlined in these Terms, marketing results are influenced by many factors outside our control, including market conditions, competition, and your own business practices.
13.1 Upon full payment, you own the website content, design assets, and copy we create specifically for you.
13.2 We retain ownership of proprietary tools, frameworks, code libraries, CRM configurations, ad campaign templates, and any systems we have developed independently.
13.3 We reserve the right to showcase your website and results in our portfolio and marketing materials unless you request otherwise in writing.
Both parties agree to keep confidential any proprietary or sensitive business information shared during the course of our working relationship. This obligation survives the termination of our agreement.
We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, or third-party service failures.
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
